Enbridge Northern Gateway Project – Establishment of Timelines and Amendment – of Joint Review Panel Agreement

On July 6, 2012, the Canadian Environmental Assessment Act, 2012 (CEAA 2012) and the amended National Energy Board Act (NEB Act) came into force, requiring adjustments to the mandate of the Joint Review Panel reviewing the Enbridge Northern Gateway project.

The federal Minister of the Environment and the National Energy Board have amended the Joint Review Panel Agreement for this project as follows:

  • The timeline for the Joint Review Panel to submit its report is 543 days, which extends from coming into force of CEAA 2012 on July 6, 2012 through to December 31, 2013. This is consistent with the revised timelines recently announced by the Joint Review Panel and will be the maximum time available for the panel to complete its work.
  • The timeline for the Government's decision statement is 180 days (approximately six months) from submission of the Joint Review Panel's report and its Regulatory Recommendation. If the project is approved, the National Energy Board will issue a Certificate of Public Convenience and Necessity within 7 days of the Government's decision statement.
  • Reporting requirements have been integrated to ensure the Joint Review Panel's report identifies those conclusions and recommendations that relate to the environmental effects to be taken into account in the decision statement.
