Decision

Environment Canada, Transport Canada and the Hamilton Port Authority have taken the following course of action on August 7th, 2013 relating to the comprehensive study of the Randle Reef Sediment Remediation Project. The authorities may exercise any power or perform any duty or function with respect to the project because, after taking into consideration the comprehensive study report and taking into account the implementation of appropriate mitigation measures, the authorities are of the opinion that the project will not likely result in any significant residual adverse environmental effects.

Implementation of mitigation measures is required for the project to address its effects on:

• air quality
• ambient noise
• soil quality
• surface water quality
• aquatic biota
• species at risk
• residential areas
• industrial/commercial/municipal land use and infrastructure
• Sherman inlet
• public health and safety
• recreational use of the harbour, and
• shipping and navigation

A follow-up program to verify the accuracy of the environmental assessment and/or determine the effectiveness the measures taken to mitigate the adverse environmental effects is required and will be undertaken by Environment Canada and other federal authorities responsible for this project.
