Reasons for a Federal Assessment

On May 17, 2012, it was determined that an environmental assessment was required in relation to the project because Fisheries and Oceans Canada considered taking action in relation to subsection 35(2) of the Fisheries Act.

Project Description (as posted in the Notice of Commencement)

The project includes the complete decommissioning of the existing Balaclava dam and roadway that overtops it, the isolation of various sections of the construction site over a two year period while the existing structures are removed and a new and larger dam structure and roadway are built, encroaching upstream into Constant Lake. These works are being undertaken in order to meet the water management requirements of the Ontario Ministry of Natural Resources.

The scope of the project consists of the removal of the existing dam and associated roadway, including various isolation works over the two year build schedule, and the construction of a new dam occupying the same location as well as upstream into Constant Lake, as well as all staging areas, storage sites and access points.

Final Decision

A decision was taken on June 13, 2012 and was that the authority may exercise any power or perform any duty or function with respect to the project because, after taking into consideration the screening report and taking into account the implementation of appropriate mitigation measures, the authority is of the opinion that the project is not likely to cause significant adverse environmental effects.
