Notice of Determination 

Delta, B.C. – October 13, 2022– The Vancouver Fraser Port Authority and Transport Canada have determined that the proposed Annacis Auto Terminal Optimization located at 820 Dock Road (Annacis Island), Delta is not likely to cause significant adverse environmental effects.

This determination was based on a consideration of the following factors: 

  • Impacts on rights of Indigenous peoples  

  • Indigenous knowledge 

  • Community knowledge 

  • Comments received from the public 

  • Technically and economically feasible mitigation measures 

Mitigation measures taken into account for this determination are:  

  • Activities will be carried out in accordance with the construction environmental management plan (CEMP) 

  • A qualified environmental professional will be retained to monitor works and activities with the potential to negatively affect species or habitat with special status 

  • A spill prevention, containment, and clean-up plan will be developed for the project, be available in the immediate working area, and project personnel will be trained on spill prevention, containment, and clean-up 

  • The works will not deposit a deleterious substance in water inhabited by fish, or affect fish or fish habitat in a manner contrary to the Fisheries Act 

  • Soils excavated from the Project site that are not suitable for backfill will be disposed of at approved licensed waste management facilities 

  • An archaeological chance find procedure will be implemented in the event that archaeological resources are encountered 

  • Surveys will be conducted prior to the start of activities with the potential to disturb birds and their nests and additional mitigation measures to reduce the potential for adverse effects (i.e., harm, harass, kill a species, or destroy critical habitat) will be implemented as detailed in the construction CEMP 

  • Construction debris and waste materials will be collected in the immediate working area and disposed of at an appropriately licensed facility 

  • Erosion and sediment control measures will be implemented to prevent the dispersal of silts and fines into stormwater infrastructure that discharges to the Fraser River 

The Vancouver Fraser Port Authority and Transport Canada are satisfied that the carrying out of the project is not likely to cause significant adverse environmental effects. 

Therefore, the Vancouver Fraser Port Authority and Transport Canada may carry out the project, exercise any power, perform any duty or function, or provide financial assistance to enable the project to be carried out in whole or in part.
