Notice of Determination

Ottawa, Ontario – April 7, 2026 - The National Capital Commission has determined that the proposed project is not likely to cause significant adverse environmental effects with the application of all recommended mitigation measures.

This determination was based on a consideration of the following factors:

  • comments received from the public;
    • Court design and amenities
    • Court placement and noise concerns
    • Accessibility and connectivity
    • Environmental considerations
  • technically and economically feasible mitigation measures.
  • the components of the environment that are within the legislative authority of Parliament identified in the "Definitions" section of the Impact Assessment Act. 

Key mitigation measures taken into account for this determination include:

  • Develop and implement:
    • An erosion and sediment control plan.
    • A soil management plan.
    • An emergency spill response plan.
    • A wastewater and stormwater management plan.
    • Contaminant prevention plan.
    • A tree and vegetation protection plan.
    • An environmental protection plan.
    • A historical, archaeological, cultural resources plan.
  • Remove vegetation outside of the bird nesting and bat maternity seasons (April 1st to August 31st, May 1st to September 30th respectively) to prevent impacts on individuals and their residences.

The National Capital Commission is satisfied that the carrying out of the project is not likely to cause significant adverse environmental effects.

Therefore, the National Capital Commission may carry out the project, exercise any power, perform any duty or function, or provide financial assistance to enable the project to be carried out in whole or in part.
