Notice of Determination

Vancouver B.C. – April 16, 2026 – The Vancouver Fraser Port Authority has determined that the proposed Pier 61 decommissioning - located in Burrard Inlet, east of the Second Narrows Bridge is not likely to cause significant adverse environmental effects.

This determination was based on a consideration of the following factors:

  • Impacts on rights of Indigenous peoples
  • Indigenous knowledge
  • Technically and economically feasible mitigation measures

Best efforts were made to consult the following Indigenous groups:

  • Kwikwetlem First Nation
  • Musqueam Indian Band
  • S'ólh Téméxw Stewardship Alliance
  • Squamish Nation
  • Tsleil-Waututh Nation
  • Snuneymuxw First Nation
  • Cowichan Tribes
  • Halalt First Nation
  • Lyackson First Nation
  • Penelakut Tribe
  • Stz'uminus First Nation

The port authority received comments during Indigenous consultation relating to habitat offsetting, rip rap, birds and bats, fish scans, water quality, and marine mammals. The conditions in the permit, including a requirement to carry out the Project in accordance with the construction environmental management plan provided by the Permit Holder, have addressed the comments. Based on the record of consultation, the port authority is of the view that the duty to consult has been met.

Mitigation measures taken into account in making the determination include:

  • The Permit Holder shall adhere to a construction environmental management plan
  • The Permit Holder shall use reasonable efforts to retain existing native riparian vegetation and native soil. Disturbance or clearing of vegetation shall be staged and strictly limited to that required for the Project.
  • If there is potential to affect bats, the Permit Holder shall conduct bat surveys. Surveys must be completed by a qualified environmental professional.

The Vancouver Fraser Port Authority is satisfied that the carrying out of the project is not likely to cause significant adverse environmental effects. Therefore, the Vancouver Fraser Port Authority may carry out the project, exercise any power, perform any duty or function, or provide financial assistance to enable the project to be carried out in whole or in part.
