Notice of Determination

Nanaimo, B.C. - October 27, 2021 - The Nanaimo Port Authority has determined that the proposed GRT Holdings Ltd. Construction and Operation of a Soil Treatment Facility at Duke Point Industrial Park in Nanaimo, BC is not likely to cause significant adverse environmental effects.

This determination was based on a consideration of the following factors:

· Impacts on rights of Indigenous peoples;
· Indigenous knowledge;
· community knowledge; and
· technically and economically feasible mitigation measures.

Mitigation measures were developed for soil, surface (storm) water and ground water management, lighting, noise, air quality, view and shade, traffic and archaeology for both the construction and operation phases of the project.  Some of the primary measures taken into account for this determination are:

• All works will be carried out in accordance with the Construction Environmental Management Plan

• A qualified environmental professional will be retained to monitor works and activities with the potential to negatively affect the environment as well as to complete annual reporting requirements  

• An archaeological chance find procedure will be implemented, in the event that archaeological resources are encountered

• The permit holder will prevent the deposit a deleterious substance in water inhabited by fish, or affect fish or fish habitat in a manner contrary to the Fisheries Act

• A spill prevention, containment and clean-up plan will be developed for the project, be available in the immediate working area, and project personnel will be trained on spill prevention, containment, and clean-up

• Activities involving the use of concrete, cement, or other lime-containing construction materials will be conducted so that the materials do not enter the aquatic environment

• There will be no in-water works.

The Nanaimo Port Authority is satisfied that the carrying out of the project is not likely to cause significant adverse environmental effects.

Therefore, the Nanaimo Port Authority may carry out the project, exercise any power, perform any duty or function, or provide financial assistance to enable the project to be carried out in whole or in part.
