NOTICE OF DETERMINATION

July 4th 2022 – Transport Canada has determined that the construction of an extension of a hangar by Air Inuit at Kuujjuaq Airport is not likely to cause significant adverse environmental effects.

This determination was based on a consideration of the following factors:

  • impacts on rights of Indigenous peoples;
  • Indigenous knowledge;
  • community knowledge;
  • comments received from the public; and
  • technically and economically feasible mitigation measures.

Mitigation measures taken into account for this determination are:

  • Make sure to recover and reuse as much as possible the materials that show no signs of contamination. If reuse is not possible, the excavated material must be stored on and covered with a waterproof membrane until it is disposed of off-site in an authorized site in accordance with the provincial regulations in force.
  • Excavated soil must be transported in such a way that it does not spread back into the environment.
  • The backfill materials required for the work must be clean, that is to say less than criterion "A" of the Guide d'intervention, Protection des sols et réhabilitation des terrains contaminés of the MDDELCC, and show no signs of contamination by residual materials. A certificate of chemical analysis must be presented to confirm the environmental quality and the origin of the soils.
  • It is the responsibility of the contractor to identify the underground infrastructures before the start of the excavation work.
  • Based on the specifications submitted as part of this application process, we anticipate that the storage tank will be subject to the Petroleum and Allied Petroleum Products Storage Tank Systems Regulations (SOR/2008-197). If applicable:
  • The tank must be installed in accordance with the requirements of the CCME Environmental Code of Practice for Aboveground and Underground Related Petroleum Storage Tank Systems.
  • All work related to the removal of the existing tank and the installation of the new one must comply with the Regulation respecting storage systems for petroleum products and related products (RSSPPPA) including, but not limited to, the following:
  • The plans for the storage system must be stamped by an engineer;
  • The tank must be designed and installed in accordance with article 14 of the RSSPPPA;
  • The tank must be installed by a person who holds an appropriate license from the Régie du Bâtiment du Québec;
  • The petroleum product transfer area must be designed in accordance with article 15 of the RSSPPPA to prevent releases in liquid form from reaching the environment during the transfer. In particular, the tank must be installed on a waterproof and solid surface;
  • A contingency plan must be developed before the first transfer of product to the storage system. Specify the location of emergency response equipment (e.g. spill kits, fire extinguishers);
  • The tank system must be registered with Environment and Climate Change Canada (ECCC). The identification number must be displayed on the system before the first transfer of the product into the system;
  • The documents and records required by the RSSPPPA must be kept for at least five years at the location of the storage system.
  • Make sure to protect any component of the system against contact with machinery or vehicles during and after the work, for example, using bollards.
  • Obtain a transport manifest and a disposal certificate for the dismantled tank following its disposal in an accredited site as well as for all debris, waste, sludge or fluids generated by the work.
  • Prohibit any discharge of water from the construction site into the ditches.
  • The contractor must take the necessary measures to comply with the laws and regulations pertaining to the presence of migratory birds, including, but not limited to, the Species at Risk Act, the Migratory Birds Convention Act, 1994 and the Migratory Birds Regulations. Some measures to minimize impacts on birds include:
  • During the nesting period, avoid approaching birds or their nests (early May to mid-August).
  • Do not damage migratory bird nests, especially those in the gravel piles near the work.
  • Avoid approaching or disturbing any bird or bird's nest if observed during the work.
  • Operations related to the removal of the existing septic tank as well as the installation, operation, maintenance and emptying of the new septic tank must be carried out in accordance with the Regulation respecting the evacuation and treatment of waste water from isolated dwellings Q-2, r. 22 if applicable to your installation.
  • Ensure that equipment and machinery are in good working order and free from hydrocarbon leaks.
  • Carry out maintenance, cleaning and refueling of equipment and vehicles in the areas provided for this purpose, on a waterproof surface, at a distance of at least 30 m from watercourses and 15 m from drainage ditches.
  • The contractor must comply with all the regulations in force concerning transportation, storage, handling and disposal of hazardous materials and hazardous waste.
  • Hazardous materials used during the work must be stored in a safe place and transported in well-identified sealed containers.
  • Hazardous waste must be managed and disposed of according to the regulations in force by a company that holds authorizations from the MELCC. Keep the transport manifest and the hazardous waste disposal certificate.
  • Have an emergency response plan in case of accidental spillage of hazardous materials. Ensure that the intervention plan contains, at a minimum, an intervention diagram and an alert structure, and that in addition to being known to all workers on the site, it is placed in an easy place access for all employees.
  • Appropriate fire extinguishers must be present on the work site.
  • An emergency kit in the event of a hazardous material spill must be present at all times on the work site.
  • In the event of a spill, recover any contamination, whether it is the spilled product, the soil or the water affected by this contamination and dispose of it according to the regulations in force. Notify the airport manager immediately. A rehabilitation report must be produced.
  • Any spill with environmental consequences must be reported to the ECCC emergency services (1-866-283-2333) and to the MELCC Environmental Emergency Service (1-866-694-5454).

Transport Canada is satisfied that that the carrying out of the project is not likely to cause significant adverse environmental effects.

Therefore, Transport Canada may carry out the project, exercise any power, perform any duty or function, or provide financial assistance to enable the project to be carried out in whole or in part.
