NOTICE OF DETERMINATION

Halifax (Nova Scotia) – June 28, 2023 Transport Canada, Fisheries and Oceans Canada, and the Halifax Port Authority have determined that the proposed Halifax Shipyard Land Level Expansion is not likely to cause significant adverse environmental effects with mitigation measure as outlined in their evaluation and can therefore proceed.

This determination was based on a consideration of the following factors:

  • impacts on rights of Indigenous peoples;
  • Indigenous knowledge;
  • community knowledge;
  • comments received from the public; and
  • technically and economically feasible mitigation measures.

Mitigation measures taken into account for this determination are:

  • Sediment control measures will be implemented during dredging and infilling and sediment levels in the water will be monitored.
  • Dredge material will be monitored for unexpected objects such as artifacts.
  • A site-specific Environmental Protection Plan (EPP) will be developed and implemented. It will include spill response and mitigation plans and procedures to avoid and respond to wildlife encounters.
  • Infill material will be placed, handled and stored in accordance with an approved Material Management Plan.
  • Project activity in the water will be coordinated with the HPA Harbour Master to prevent impacts to navigation.

Transport Canada, Fisheries and Oceans Canada, and the Halifax Port Authority are satisfied that that the carrying out of the project is not likely to cause significant adverse environmental effects.

Therefore, the authorities may carry out the project, exercise any power, perform any duty or function, or provide financial assistance to enable the project to be carried out in whole or in part.
